APVMA-Approved Pesticides
Under the Act, the technician must not use a pesticide for the activity unless the pesticide is a substance that is Australian Pesticides and Veterinary Medicines Authority (APVMA) approved for use to carry out the activity.
The licensed technician will ONLY use pest management agents and products that have been approved by the APVMA and registered for use within the applicable State or Territory, or under a Permit issued by the APVMA or State Authority.
It is important to note that the effectiveness of this pest management program may be compromised if you fail to implement the recommended hygiene procedures, such as altering the building or landscaping, or introducing materials that are conducive to or infested with pests.
While we exercise utmost care during the application of APVMA-approved pesticides, neither Green Shield Pest Control nor the licensed technician shall be held liable for any staining that may occur on timbers, fabrics, wall coverings, floor coverings, or any other articles. You assume all responsibility and indemnify us against any costs arising from such potential damages, and we do not provide rectification works.
In situations where concrete drilling, cutting, or both are necessary to apply an APVMA-approved pesticide, Green Shield Pest Control and the licensed technician bear no liability for any damages resulting from concealed services such as power, gas, water, etc. It is your responsibility to provide clear and accurate plans before commencing any site work of this nature. You assume all responsibility and indemnify us against any costs arising from such potential damages, and we do not provide rectification works.
Precautions to be Taken Before, During, and After Treatment
The following precautions must be taken by individuals to minimize exposure to any pesticide used for pest management activity:
Prior to commencement of work, individuals must inform us of any persons or pets on-site, allergies, or other health concerns. As a precaution, individuals who may be particularly sensitive or suffer from allergic reactions should remain off-premises for up to twenty-four (24) hours and not return until after the premises have been thoroughly ventilated. Air-conditioners should be left on ‘vent mode’ for at least four hours after the treatment or re-occupying to circulate outside air into the building.
If anyone suspects that they have come into contact with a treated area and have been affected, they should contact the Poisons Information Centre on 13 11 26 and have this notice with them.
Food items and utensils for humans, pets, and animals should be covered before treatment, as directed.
During treatment, individuals must remove or protect any people, animals, birds, or fish. All pets and animals should be kept away from treated areas until dry, and any odour has cleared, as directed.
Clothing and items must be removed from the clothesline before treatment, as directed. Contact with treated surfaces should be avoided until the insecticide has dried, which could take three (3) to twenty-four (24) hours.
During external treatments, doors and windows should be closed, and they should remain closed until the odour has cleared, which can take up to twenty-four hours.
When gaining access to or working in the roof void or subfloor areas, overalls and gloves should be worn, and a respirator should be used to avoid contact with any insecticidal products. The overalls and gloves should be washed immediately and separated from other washing or disposed of as soon as practicable.
You must follow any verbal advice given by our firm or licensed technician during treatment.
Statement of Warranties
- If structural or environmental conditions prevent performing any treatments during the program quoted, we retain the right to review and revise the terms of the FREE Service Period or the cost of your investment.
- Unless we provide specific written arrangements, the total contract price shall be due and recoverable by Green Shield Pest Control on the commencement of works.
- Any FREE Service Period shall become null and void unless all monies due and payable to Green Shield Pest Control are paid in full.
- Where we provide a FREE Service Period, we agree to provide such remedial treatment as may be required to the nominated property, at no cost to you, for the term of the FREE Service Period set by the licensed technician upon notification by you.
- Any FREE Service Period is conditional upon immediately notifying us of the signs of the suspected pest infestation. We will perform a remedial only to affected areas and follow the strict limits concerning the number of treatments per year detailed on the product label.
- No responsibility is accepted, nor warranty expressed or implied, for any damage or consequential losses due to past, current, or future pest activity.
- The proposed treatment only applies to the pest species nominated by the licensed technician, and the program does not provide for a Pest Management Program against untreated pests.
Statement of Limitation
The following statement outlines the limitations of our services:
- We do not make any efficacy claims for general pest control and termite control treatments beyond the claims made by the manufacturer of each APVMA-approved pesticide. The effectiveness of the treatments is subject to the environmental conditions, hygiene, and sanitation requirements specified on the latest APVMA-approved product label.
- We strictly adhere to the number of residual applications indicated on the product label per year and do not exceed this limit.
- We do not apply insecticides “off label” to treat pests that are not listed on the APVMA-approved product label.
- Our treatments are administered solely at the registered application rates specified on the product label for the target pests.
- The effectiveness of external general pest control treatments can last up to three months, depending on the claims made by the APVMA-approved pesticide we utilize.
Internal general pest control treatments can remain effective for up to three months, depending on the claims made by the APVMA-approved pesticide we employ. - At the commencement of the service, your technician will provide you with an assessment of the level of control achieved through your pest management program.
Limitation of Liability
To the fullest extent permissible by applicable law:
- This agreement does not impose any liability upon us (whether arising from contract law, common law, or otherwise) for any consequential, indirect, or special loss or damage of any kind, including but not limited to those resulting from delays, product failures, loss of production, business interruptions, loss of revenue, loss of profits, or loss of opportunities.
- In the event of a claim pertaining to a guarantee or warranty under the Australian Consumer Law, our liability to you under this agreement, whether arising from contract, tort (including, without limitation, negligence), or any other legal theory, is limited to the repair or replacement of the Equipment or the cost of such repair or replacement, as determined by our absolute discretion, and in the case of Services, it is limited to the price of resupplying those Services.
- Under all other circumstances, our liability to you (including in contract, negligence, tort, or any common law or statutory right) under this agreement shall not exceed the total fees received by us from you as stipulated in this agreement. We shall not be held liable for any claims arising from injury, loss, or damage, whether caused by negligence or any other cause, to you, your property, or any third party, as a result of providing the Services, the Equipment, or any additional items.
